  1. Fees and Payment Options
    1. To complete your enrolment in a course and be able to attend the course, you must pay your course fee in full. You will not be enrolled and guaranteed a place in the course until full payment has been received.
    2. Course fees are outlined at your course selection. All course fees, including those quoted, are subject to variation without notice. Your course fee is only guaranteed once paid by you in full.
    3. A payment surcharge of 2% will apply when paying by credit card or Paypal. This represents the cost of the business for accepting payment of this type.
    4. Unless otherwise stated, the course fees are exclusive of GST.
  2. Entry Requirements
    1. To be eligible to attend a course, you must, on the day of commencement of the relevant course, be at least 18 years of age, however FlexiMinds may, in its sole discretion, offer places to underage participants where:
      1. they meet the minimum requirements for admission in clause 2.2; and
      2. course places are available.
    2. FlexiMinds may, in its sole discretion and subject to availability, offer places to participants under 18 years of age where:
      1. the course is deemed suitable to persons under the age of 18 by FlexiMinds in its sole and absolute discretion including but not limited to the subject matter of the course; and
      2. welfare arrangements for the participant is agreed prior to the course. For example:
        1. a parent or guardian transports and collects the participant from a course venue; and/or
        2. a parent or guardian accompanies the participant in the course.
      3. a parent or guardian accepts in writing these terms and conditions prior to the course.
  3. Course Venues
    1. Course venues are outlined at your course selection. All participants use these facilities entirely at their own risk. FlexiMinds does not accept responsibility for:
      1. any damage or injury resulting from the use of the facilities; or
      2. any lost or stolen items or damage to property or vehicles.
    2. You will be responsible for any damage or injury caused wilfully or negligently by you and you release and indemnify FlexiMinds for all such damage or injury.

      For Groups
    3. You may elect to have a course conducted at your own venue or at a venue organised by you at your sole cost and expense if agreed prior to the course.
    4. If clause 3.3 applies, the parties agree that the use of those facilities shall be at your risk. You release and indemnify FlexiMinds and its consultants and suppliers for damage, loss, injury or death unless it is caused by the negligence of FlexiMinds or its consultants or suppliers.
  4. Refund Policy
    1. Subject to clause 4.2, a refund of your course fee will be given where you enrolled in a course that has been cancelled by FlexiMinds.
    2. A refund of your course fee will not be made if FlexiMinds is unable to attend on a course date for any reason, in which case the course will be provided within a reasonable time thereafter at no further cost of you.
    3. You may be eligible for a partial refund in the following circumstances:
      For Individuals
      1. Where you advise FlexiMinds in writing more than two (2) weeks before the course date that you wish to cancel, in which case 100% of the course fee will be refunded to you.
      2. Where you advise FlexiMinds in writing within two (2) weeks before the course date that you wish to cancel, in which case 50% of the course fee will be refunded to you.
      For Groups
      1. Where you advise FlexiMinds in writing more than one (1) month before the course date that you wish to cancel, in which case 100% of the course fee will be refunded to you.
      2. Where you advise FlexiMinds in writing within one (1) month before the course date that you wish to cancel, in which case 50% of the course fee will be refunded to you.
    4. In all cases, any payment surcharge will not be refunded.
    5. You can defer your course in FlexiMinds’ sole and absolute discretion, however, if you do not attend the substitute course within a reasonable time, your course fee will be forfeited in full.
  5. Guarantees and Warranties
    1. Our service comes with guarantees that cannot be excluded under the Australian Consumer Law, such as a guarantee that courses are to be provided with due care and skill, fit for their specified purpose, and delivered within a reasonable time (when there is no agreed end date).
    2. If FlexiMinds fails to meet a guarantee, and that failure is reported to FlexiMinds within one (1) month of the date of completion of the course, then FlexiMinds will remedy the failure subject to these terms and conditions.
    3. In the event FlexiMinds fails to meet a guarantee, the following procedure shall be followed:
      1. You must contact FlexiMinds at the earliest possible opportunity and no later than one (1) month of the date of completion of the course and provide the following minimum information:
        1. Date of course and participant’s name;
        2. A detailed description of how you say FlexiMinds has failed to meet a guarantee ; and
        3. Your preferred remedy noting you cannot demand a refund immediately if the failure is minor and can be fixed. FlexiMinds must have the opportunity to fix the problem.
      2. FlexiMinds may require a report from the supplier of the course to be completed.
      3. FlexiMinds reserves the right to remedy the failure in its sole and absolute direction. This decision will take place after considering all of the information received.
    4. FlexiMinds will not be liable to compensate you for any delay in remedying your claim or in properly assessing your claim.
    5. Once the claim has been approved by FlexiMinds or otherwise, FlexiMinds will make reasonable attempts to contact you to advise the outcome of the claim.
    6. Any replacement course will be provided within a reasonable time after FlexiMinds has made contact with you at no cost to you.
  6. Warranty Disclaimer
    1. FlexiMinds and/or its consultants and suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information and services provided for any purpose. To the maximum extent permitted by applicable law, all such information and services are provided “as is” without warranty or condition of any kind. FlexiMinds and/or its consultants and suppliers disclaim all warranties and conditions with regard to this information and services. To the maximum extent permitted by applicable law, in no event shall FlexiMinds and/or its consultants and suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages or any damages arising out of or in any way connected with the provision of or failure to provide services, or for any information and services obtained through FlexiMinds and/or its consultants and suppliers.
    2. To the extent permitted by law, neither FlexiMinds and/or its related entities accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expenses or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure, or any other event which is beyond FlexiMinds’ control.
  7. Copyright
    1. You represent, warrant and agree that you will use the service only for your personal, non-commercial, entertainment use and not for any redistribution of the information or other restricted use.
    2. You agree not to infringe the rights of FlexiMinds’ copyright and to comply with all applicable laws in your use of the information.
    3. You agree that you will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, sub-license or otherwise transfer or use the information.
    4. You acknowledge that the information embodies the intellectual property of FlexiMinds and is protected by law.
